1. PRELIMINARY REMARKS

At Éditions Gladius International inc (the "Company" or "we") we believe that the protection of personal information is of paramount importance. That is why we have established this privacy policy (the "Policy") outlining the manner in which the Company collects, uses, communicates and protects your Personal Information (as that term is defined below) in connection with your use of the Websites.

Unless otherwise defined in this Policy, capitalized terms have the meaning given to them in the General Terms and Conditions.

2. MEANING OF PERSONAL INFORMATION

For the purposes of this Policy, "Personal Information" means any information that relates to a natural person and allows that person to be identified.

3. COMPLIANCE

Through the implementation of this Policy, the Company undertakes to comply with the provisions of the Act respecting the protection of personal information in the private sector (Québec, c. P- 39.1) with respect to the collection, holding, use and communication of your Personal Information.

4. CONSENT

By providing Personal Information to the Company or its agents, you agree that we may collect, use or disclose such Personal Information in accordance with this Policy, the privacy preferences you have indicated to us and as permitted or required by law.

Except as otherwise expressly permitted by law, the Company will not use or disclose your Personal Information to anyone except as set out in this Policy.

5. COLLECTION OF PERSONAL INFORMATION

In certain circumstances, the company may ask you to provide certain Personal Information, for example, when you register on its Web site, enter a contest or post comments on the Web site. You are free to choose whether or not to provide any Personal Information. If you refuse, you will still have access to most of the Web site. However, you will not be able to access the sections that require you to provide such Personal Information.

The Personal Information you provide will be used primarily for the following purposes, in addition to those expressly identified at the time of collection:

  • Help the Company to ensure the relevance of the website by adapting the content to your personal needs;
  • To help the Company evaluate and improve the website;
  • Optimize your customer experience when using the website;
  • Complete a transaction initiated via the website;
  • Provide after-sales service following a transaction completed via the Web site;
  • Allow you to register on the Web site and identify yourself thereafter;

6. SHARING PERSONAL INFORMATION WITH THIRD PARTIES

The Company may share some of your Personal Information when necessary to provide you with the services you expect and are entitled to. Although it cannot be held responsible, the Company undertakes to take the means reasonably necessary to ensure that Personal Information shared with third parties is stored in a manner consistent with this Policy.

Thus, we may communicate your Personal Information to the following persons in the circumstances indicated below:

(a) Communications to service providers

We may disclose your Personal Information to other companies that perform services for us or on our behalf. In addition, we may disclose your Personal Information to an organization or individual retained by the Company to evaluate your creditworthiness or to collect outstanding debts on an account, or to our auditors. We will only provide these companies with the information they need to provide the service, and they are prohibited from using this information for any other purpose.

For example, the Company shares certain Personal Information with its service providers in the following cases:

  • For the display of targeted advertising on the Web site or within products offered by the Company, such as newsletters.
  • Payments for online purchases made via the Éditions Gladius International inc. website are processed by the Paypal secure payment system.
  • The information transmitted is essential for processing your payment. Your credit card number is only used for the transactions you will make on the Éditions Gladius International inc. website. It is not accessible to the Company or to anyone else at the time of the transaction, except for the Paypal online payment service.
  • All Personal Information transmitted at the time of your order, including your credit card number, in addition to remaining strictly confidential, is encrypted so that it cannot be intercepted. A small locked padlock at the bottom of the browser window and a URL beginning with "https://" rather than "http://" indicate that the page on which you are making your transactions is protected by the SSL (Secure Sockets Layer) protocol.

(b) Communication to members of our Company

We may disclose your personal information to any of the business units within the Company in order to better serve you and to provide you with information about our group's products and services.

(c) Disclosure in connection with business transfers

The Company may be involved in the sale or transfer of some or all of its business. As part of such a sale or transfer, the Company may disclose your Personal Information to the purchasing organization, but will require the purchasing organization to agree to protect the confidentiality of your Personal Information in a manner consistent with this Policy.

(d) Law Enforcement and Legal Disclosure

The Company may disclose your Personal Information to a government agency that has asserted its lawful authority to obtain the information or where the Company has reasonable grounds to believe the information could be useful in the investigation of unlawful activity, or to comply with a subpoena or warrant or an order made by a court, person or body with jurisdiction to compel the production of information, or to comply with a court order to produce records of information. The Company may also disclose your Personal Information to its legal counsel.

7. NAVIGATION INFORMATION

Navigational information is used, among other things, to measure the interest and use made by Internet users of certain parts of the Web site and the My Account section, as well as the effectiveness of certain promotional programs administered by or on behalf of the Company. This information cannot identify you; rather, it is statistical data concerning the duration of the visit, the pages consulted, the order in which the pages were visited, etc.

We use the services of Google Analytics to collect navigational information on our website and in the My Account section. 8.RETENTION OF PERSONAL INFORMATION

The Company undertakes to retain your Personal Information only for as long as is necessary to fulfill the purposes identified in this Policy and for as long as your User Account exists.

When a User Account is closed or when a transaction initiated via the Web site is completed, some of the Personal Information related to that User Account or customer may be retained in our files. This Policy applies to the Personal Information of our former Users and customers, and we take the same care and precautions with respect to them as we do with respect to our current Users and customers.

In addition, the Company may, if necessary, retain Personal Information related to a given User Account or former customer even after the given User Account has been closed or the transaction initiated via the Website has been completed, in order to (i) fulfill any legal obligation that may be imposed on it by law or otherwise, (ii) resolve any dispute, (iii) prevent fraud or abuse, or (iv) enforce this Policy or the Terms and Conditions.

9. ACCESS TO YOUT PERSONAL INFORMATION

Your Personal Information is only accessible by those employees and members of our organization for whom such access is necessary to fulfill their obligations.

10. ACCESS TO YOUR FILE

At any time, you may request that the Company provide you with a list of the Personal Information it holds about you and, if applicable, inform you whether your Personal Information has been disclosed to third parties (your "File"). Access to your File is free of charge. However, a reasonable fee may be charged if you request a transcription, reproduction or transmission of your File. We will inform you in advance, if applicable, if any fees may apply to your request.

11. ACCURACY OF YOUR PERSONAL INFORMATION

The Personal Information you provide to the Company should be as complete, accurate and up-to-date as possible.

You may at any time request that your File be updated to correct any errors or to supplement any Personal Information contained therein. In addition, you may request that any Personal Information that has become obsolete or irrelevant to the purposes described in this Policy be deleted from your File. To do so, please contact us.

12. MODIFICATION

The Company may, at any time and at its sole discretion, amend this Policy. We will notify you by posting the amended version of the Policy, which then becomes effective, on this page.

If you do not agree with one or more of the changes to the Policy, you must cease all use of the Websites and, if applicable, close your User Account. Your continued use of the Websites or failure to close your User Account after the Company has posted the changes will constitute your acceptance of the changes to the Policy.
