When you place an order, you are making an offer to purchase. Gladius boutique reserves the right to accept or refuse your order, for any reason, at its sole discretion. Your order is only considered accepted upon written confirmation from Gladius boutique. We must receive and process your payment before your order is validated. Please check your order carefully before submitting it, as Gladius boutique may not be able to accept cancellation requests once the order is confirmed. In the event that we change or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made.

You represent and warrant that: (i) your credit card information is accurate, correct, and complete, (ii) you are authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay the charges incurred by you at the posted prices, including shipping and handling fees and all applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY

We cannot be held responsible for delivery or shipping delays. All delivery times provided are estimates and are not guaranteed. We disclaim all liability for delays caused by carriers, customs formalities, or any event beyond our control. As soon as the products are handed over to the carrier, ownership and risk of loss transfer to you.

You agree to indemnify, defend, and hold harmless Gladius boutique, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers, harmless from any loss, damage, liability, or claim, including reasonable attorneys’ fees, made by any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

We will notify you of any claim covered by this indemnity, provided that a failure to provide prompt notice shall not relieve you of your obligations, except to the extent you are substantially prejudiced thereby. The following shipping terms are an integral part of these Terms of Service and are deemed accepted upon placing any order.

Shipping Terms

Shipping – Quebec and Ontario

Prepaid shipping for orders of $2,500 or more before taxes, for regular merchandise available for immediate shipment.
For any order under $2,500, shipping charges will be added to the invoice:
- Minimum: $10.00
- Maximum: 7% of the order value
The following fees will be charged when applicable:
- Tailgate
- Inside delivery
- Waiting time
- Out-of-zone delivery

Unless otherwise requested by the customer, backordered (BO) products will remain in our system and will be shipped as soon as they become available.

Éditions Gladius International reserves the right to modify prices or items at any time without notice.

Shipping – Canada (excluding Quebec and Ontario)

Shipping charges and payment terms must be approved by Éditions Gladius International.
